Terms and conditions

These terms and conditions apply to every offer and every contract between Hanvos Elektra Techniek B.V. (trading as Instalpunt.com) and you as the buyer, unless the parties have expressly agreed otherwise in writing.

Article 2 — Applicability

These terms apply to every offer and every distance contract between the seller and the consumer. Before the contract is concluded, the text of these terms is made available to you electronically in a way that allows you to store it easily on a durable medium.

Article 3 — The offer

If an offer has a limited period of validity or is subject to conditions, this is stated expressly in the offer. The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors in the offer do not bind the seller.

Article 4 — The contract

The contract is concluded when you accept the offer and meet the conditions attached to it. You will receive an order confirmation by email as soon as possible.

Article 5 — Right of withdrawal

You have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason. During this period, handle the product and its packaging with care. Notify us of your withdrawal in writing (email), using the model withdrawal form or any other unambiguous statement. Full details are on the Returns page.

Exceptions

The right of withdrawal does not apply to goods made to your specifications or clearly personalised.

Article 6 — Costs in case of withdrawal

If you exercise your right of withdrawal, only the cost of returning the product is at your expense. After notifying us, you have 14 days to send the product back. We refund the amount due, including the delivery costs, within 14 days of your notification, provided we have received the product back in good condition.

If the product or its packaging is damaged beyond what is needed to examine it, we may charge you for the reduction in value. Please handle the product with care and pack it well for the return.

Article 6a — Business customers

This article applies only to customers acting in the course of a trade or profession (business customers), for example installers. A customer is treated as a business customer if a company name and/or a company registration or VAT number is given with the order, or if the nature or volume of the order shows that it is for business use. Articles 5, 6 and 14 (right of withdrawal, withdrawal costs and model form) do not apply to business customers; the statutory right of withdrawal is reserved for consumers.

Special-order items. Items not supplied from our stock but ordered specially for the business customer from the manufacturer or wholesaler (shown on the product page as a “special-order item” and/or with a delivery time) cannot be cancelled or returned after ordering, unless Instalpunt has agreed to this in writing in advance. Instalpunt may attach conditions to such agreement, including passing on the costs charged to Instalpunt by the manufacturer or wholesaler.

Stock items. Other items may only be returned by a business customer after prior consultation and approval by Instalpunt, within 14 days of receipt, unused, undamaged and in the original undamaged packaging. The costs and risk of the return are borne by the business customer. Instalpunt may charge reasonable handling costs.

The above does not affect the business customer’s statutory rights in case of non-conformity (Article 8).

Article 7 — Price

All prices are in euros, including the VAT of the customer’s country of delivery and excluding delivery costs, unless stated otherwise. Prices may change. The price at the time of ordering applies. Obvious pricing or typographical errors — where an average consumer can reasonably see that a mistake has been made — do not bind Instalpunt. If we discover such an error after your order, we will contact you as soon as possible and you may of course cancel the order free of charge with a full refund.

Article 8 — Conformity and warranty

We guarantee that the products conform to the contract, the specifications stated in the offer and the reasonable requirements of soundness and usability. The statutory guarantee applies to all products. Where applicable, the manufacturer’s warranty applies in addition, under its own conditions.

Article 9 — Delivery

We take the greatest possible care in receiving and carrying out orders. The place of delivery is the address you gave us. Accepted orders are shipped as quickly as possible and at the latest within 30 days, unless you have agreed to a longer delivery period. The usual delivery time for stock items within the EU is 3–5 working days (PostNL). Delivery costs: € 17.95 per order to Austria, Denmark, Italy, Spain and Sweden; € 24.95 per order to other EU countries. We only ship items that can be sent as a parcel (up to 32 kg).

Article 10 — Payment

Payment is made at the time of ordering by card, Apple Pay, Klarna or bank transfer. With bank transfer the order is only processed once the amount has been received in account NL02 RABO 0301 5922 25 in the name of Hanvos Elektra Techniek B.V.

Article 11 — Complaints and dispute resolution

Complaints about the performance of the contract must be submitted fully and clearly within a reasonable time to info@instalpunt.nl. We aim to reply within 14 days of receipt. Please contact us first. If the shop is a member of WebwinkelKeur and the complaint cannot be resolved together, you can contact WebwinkelKeur (www.webwinkelkeur.nl), which mediates free of charge. You can also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Article 12 — Applicable law

Contracts between you and us are governed by Dutch law. Mandatory consumer protection rules of the country where you have your habitual residence remain applicable. Unless mandatory law provides otherwise, the competent court is that of the district in which Hanvos Elektra Techniek B.V. has its registered office.

Article 13 — Changes to these terms

Changes to these terms only take effect after they have been published appropriately; if they change during the term of an offer, the provision most favourable to you applies.

Article 14 — Model withdrawal form
